After 47 Years, the National Weather Service's Daily TV Broadcast To Alaskans Will End (gizmodo.com) 74

"Alaska Weather," a daily 30-minute TV show that has broadcast across Alaska for the past 47 years, is going off the air due to a lack of funds. Gizmodo reports: In lieu of the news, residents seeking information on their state's weather will be forced to lean on spotty, sub-par internet. Friday evening will be the final television installment of "Alaska Weather," as first reported by Alaska Public Media. The show, which is the only weather program produced directly by the National Weather Service, has filled an information and communications void for decades. Without it, "if you don't have good internet connectivity, you're in a world of hurt in western and northern Alaska as far as getting weather information," said Rick Thoman, a climate specialist at the International Arctic Research Center, to the Associated Press. And many in Alaska don't have reliable or fast internet access.

General, aviation, and maritime forecast segments will remain available online only, via YouTube. Emergency alerts, like storm warnings, will be relegated to the National Oceanic Atmospheric Administration radio broadcasts, which don't cover the whole state, per Alaska Public Media. Officials from the state-owned, non-profit media organization say that money problems are to blame. Putting together and distributing "Alaska Weather" has cost Alaska Public Media $200,000 annually, and the network can't afford to do it anymore, according to Linda Wei, APM's chief content officer.

"It's no longer sustainable for us to continue in this manner," Wei told AP. "It's not a decision that we came to lightly." Big state funding cuts in 2019 left APM in a tough spot. The media org kept "Alaska Weather" going on its own for years, following the loss of state backing, but now Wei says the network can't anymore. "We've been doing this, without support, for about four or five years, and we've made that known to NOAA," said Wei to WaPo. "It just got to the point where we couldn't continue." Wei says she's hoping there's a possibility of getting "Alaska Weather" back on the air. But for now, there will be a gap.

Americans Hate ISPs Almost As Much As They Hate Gas Stations, Survey Finds (extremetech.com) 113

An anonymous reader quotes a report from ExtremeTech: Americans hate their internet service providers (ISPs) more than any other segment of the consumer economy -- except gas stations. A fresh set of rankings from the American Consumer Satisfaction Index (ACSI) reveals that few consumers are happy with the way their ISPs conduct business, preferring them only over trips to the pump in a list of 43 major industries. The rankings come courtesy of the ACSI's most recent telecommunications study, which the organization publishes annually. The study covers subscription TV services, video streaming services, and ISPs of both the fiber and non-fiber variety. Using interviews with 22,061 American consumers conducted between April 2022 and March 2023, this year's telecommunications study investigates just how happy people are with their ISPs, then pits that data against that of several other industries. This year, ISPs ranked lower than the endlessly frustrating automobile, banking, and health insurance industries, as well as 39 others that people tend to have an easier time with, such as breweries and athletic shoes.

On a satisfaction scale of 1 to 100, ISPs earned a lackluster 68, which consists of fiber's 75-point and non-fiber's 66-point satisfaction scores combined. The ACSI used customers' input on a number of experiential data points, from choosing a plan to actually using their home Wi-Fi networks, to calculate both scores and combine them based on usage. Although fiber customers found their internet to be relatively reliable and their bills easy to understand, earning an 80 in both categories, non-fiber customers weren't as impressed at 72 and 75, respectively. Unsurprisingly, both fiber and non-fiber customers enjoyed reaching out to their providers' customer service teams the least out of 14 total data points.

There was only one industry that ranked lower than ISPs. As much as Americans generally dislike the way ISPs manage hardware, pricing, customer service, outages, and more, they dislike gas stations even more, giving the category a measly score of 65. While the ACSI doesn't share respondents' reasoning (it's a telecommunications study, after all), it's easy to see why consumers might not enjoy spending obscene money to fill their tanks at dusty roadside stops.

'Kissing or Licking' Microphone Is Sexual, Twitch Says (mashable.com) 77

Earlier this week, Twitch introduced Content Classification Labels to help streamers label their content when they're doing something "mature." Streamers are supposed to use Content Classification Labels when their content contains the following: Mature-Rated Games; Sexual Themes; Drugs, Intoxication or Excessive Tobacco Use; Violent and Graphic Depictions; Significant Profanity or Vulgarity; and/or Gambling. Interestingly, kissing or licking a microphone falls under "Sexual Themes." From a report: According to Twitch's FAQ, "Examples of sexual themes include prolonged or repeated kissing of another individual or object, detailed non-educational discussions of sexual topics or experiences, and content or behavior that is very likely to elicit a mature chat conversation."

Those who love ASMR will know that repeating kisses on a mic is a classic ASMR move. The FAQ addresses this, saying: "To be more direct -- many ASMR practices are focused on mindfulness and are not sexual, but we consider kissing or licking a microphone to fall within Sexual Themes." Additionally, hot tub streams and pole dancing will fall under Sexual Themes.

US Might Finally Force Cable-TV Firms To Advertise Their Actual Prices (arstechnica.com) 67

The Federal Communications Commission (FCC) has proposed new rules to crack down on hidden fees charged by cable and satellite video providers. "My administration's top priority is lowering the cost of living for the middle class, and that includes cracking down on companies' use of junk fees to hide true costs from families, who end up paying more as a result," Biden said in a statement on Tuesday. Ars Technica reports: As Biden noted, the FCC "proposed a new rule that would require cable and satellite TV providers to give consumers the all-in price for the service they're offering up front." The proposed rule would force companies like Comcast, Charter Spectrum, and DirecTV to publish more accurate prices. Biden continued: "Too often, these companies hide additional junk fees on customer bills disguised as "broadcast TV" or "regional sports" fees that in reality pay for no additional services. These fees really add up: according to one report, they increase customer bills by nearly 25 percent of the price of base service."

FCC Chairwoman Jessica Rosenworcel first floated pricing transparency rules for the TV services offered by cable and satellite companies in March. That effort took a step forward on Tuesday when the commission approved a Notice of Proposed Rulemaking (NPRM) that seeks public comment on rules that would force video providers to offer accurate prices in advertising. "Consumers who choose a video service based on an advertised monthly price may be surprised by unexpected fees related to the cost of video programming that raise the amount of the bill significantly," the NPRM said. The cable and satellite TV companies' practice of listing "Broadcast TV" and "Regional Sports Network" fees separately from the advertised price "can be potentially misleading and interpreted as a government-imposed tax or fee, instead of a company-imposed service fee increase," and make it hard for customers to compare prices across providers, the FCC said.

The docket is available here, and comments will be accepted for 60 days after the NPRM is published in the Federal Register. The FCC said its proposal "would require cable operators and DBS [direct broadcast satellite] providers to clearly and prominently display the total cost of video programming service." The FCC is also seeking comment on whether it has the authority to impose similar requirements on other types of video providers. But Rosenworcel reportedly said in a congressional hearing that the FCC's authority under US law doesn't extend to streaming services.

The stand-off reached the boiling point in March when broadcasters formed a new anti-piracy coalition and warned of punishing legal action. Noonoo TV responded by throwing in the towel but after clone site 'Noonoo TV Season 2' appeared online, the government says it will develop an AI anti-piracy system that will stop any 'Season 3' variants in their tracks.

Alongside a promise to work closely with the Ministry of Culture, Sports and Tourism, the Korea Communications Commission, and the National Security Agency to protect 'K' content from unlawful distribution, the Ministry of Science says the time is right to enhance manual work carried out by humans with automated systems better suited to the job. "Since the detection and response to illegal sites is currently centered on manual work based on human resources, to overcome this limitation, we plan to develop technology that can automatically detect and verify new versions and substitute sites," the Ministry said. "Online video service (OTT) content is a precious asset created with the blood and sweat of many people. According to an industry insider, LCD TVs won't see any further development because all new R&D money is being spent on self-emissive displays like MicroLED and OLED, as well as on backlight technology like Mini-LED. Tom's Guide reports: According to Bob Raikes from Display Daily, it's all about OLED development. "I asked EMD (which is the US name of Merck KGaA and is by far the dominant supplier of LC materials), what they were doing to push LC materials for displays onto the next stage ... They are developing LCs for privacy windows and antennas, but they told us that 'there is no pull from clients' for significant development in LC materials," Raikes wrote in a recent article. "That shouldn't have been a surprise to me -- I have been talking about the switch to OLED and other emissive displays for the premium end (and later the mainstream) of the display market for a lot of years. Still, after decades of reporting on LC developments, it took a moment to sink in!"

As for what, specifically, manufacturers are working on, it's the production of QD-OLED panels for use in the high-end Samsung and Sony TVs like the Samsung S95C OLED and Sony A95K OLED as well as the development of PHOLED panels that use a blue phosphorescent material that has a longer shelf life and can go brighter than the traditional organic material in OLED panels. [...] Sadly, LCD TVs' days are coming to a close, but OLED TVs are still going strong.

"Silicon Valley is poised once again to cash in on other people's products, making a data grab of unprecedented scale that has already spawned lawsuits and congressional hearings. Chatbots and other forms of generative artificial intelligence that burst onto the technology scene in recent months are fed vast amounts of material scraped from the internet — books, screenplays, research papers, news stories, photos, art, music, code and more — to produce answers, imagery or sound in response to user prompts... But a thorny, contentious and highly consequential issue has arisen: A great deal of the bots' fodder is copyrighted property...

The new AI's intellectual-property problem goes beyond art into movies and television, photography, music, news media and computer coding. Critics worry that major players in tech, by inserting themselves between producers and consumers in commercial marketplaces, will suck out the money and remove financial incentives for producing TV scripts, artworks, books, movies, music, photography, news coverage and innovative software. "It could be catastrophic," said Danielle Coffey, CEO of the News/Media Alliance, which represents nearly 2,000 U.S. news publishers, including this news organization. "It could decimate our industry."

The new technology, as happened with other Silicon Valley innovations, including internet-search, social media and food delivery, is catching on among consumers and businesses so quickly that it may become entrenched — and beloved by users — long before regulators and lawmakers gather the knowledge and political will to impose restraints and mitigate harms. "We may need legislation," said Congresswoman Zoe Lofgren, D-San Jose, who as a member of the House Judiciary Committee heard testimony on copyright and generative AI last month. "Content creators have rights and we need to figure out a way how those rights will be respected...."

Furor over the content grabbing is surging. Photo-sales giant Getty is also suing Stability AI. Striking Hollywood screenwriters last month raised concerns that movie studios will start using chatbot-written scripts fed on writers' earlier work. The record industry has lodged a complaint with federal authorities over copyrighted music being used to train AI.

Reddit "appears to be laying the groundwork for ejecting forum moderators committed to continuing the protests," CNN reported Friday afternoon, "a move that could force open some communities that currently remain closed to the public.

"In response, some moderators have vowed to put pressure on Reddit's advertisers and investors." As of Friday morning, nearly 5,000 subreddits were still set to private and inaccessible to the public, reflecting a modest decrease from earlier in the week but still including groups such as r/funny, which claims more than 40 million subscribers, and r/aww and r/music, each with more than 30 million members. But Reddit has portrayed the blacked-out communities as a small slice of its wider platform. Some 100,000 forums remain open, the company said in a blog post, including 80% of its 5,000 most actively engaged subreddits...

Reddit CEO and co-founder Steve Huffman told NBC News the company will soon allow forum users to overrule moderators by voting them out of their positions, a change that may enable communities that do not wish to remain private to reopen. In addition, one company administrator said Thursday, Reddit may soon view communities that remain private as an indicator that the moderators of those communities no longer wish to moderate. That would constitute a form of inactivity for which the moderators can be removed, the company said. "If a moderator team unanimously decides to stop moderating, we will invite new, active moderators to keep these spaces open and accessible to users," the administrator said, adding that Reddit may intervene even if most moderators on a team wish to remain closed and only a single moderator wants to reopen...

Omar, a moderator of a subreddit participating in this week's blackout, told CNN Friday that many subreddits have participated in the blackouts based on member polls that indicate strong support for the protests... Content moderation on Reddit stands to worsen if the company continues with its plan, Omar said, warning that the coming changes will deter developers from creating and maintaining tools that Reddit communities rely on to detect and eliminate spam, hate speech or even child sexual abuse material. "That's both harmful for users and advertisers," Omar said, adding that supporters of the protests have been contacting advertisers to explain how the platform's coming changes may hurt brands. Already, Omar said, the blackout has made it harder for companies to target ads to interest groups; video game companies, for example, can no longer target ads to gaming-focused subreddits that have taken themselves private...

Huffman has also said that the protests have had little impact on the company financially.

NBC News adds: In an interview Thursday with NBC News, Reddit CEO Steve Huffman praised Musk's aggressive cost-cutting and layoffs at Twitter, and said he had chatted "a handful of times" with Musk on the subject of running an internet platform. Huffman said he saw Musk's handling of Twitter, which he purchased last year, as an example for Reddit to follow.

Valve Gives Steam Its Biggest Update and Redesign in Years 38

An anonymous reader shares a report: PC gamers could easily make a joke that three things in life never change: death, taxes, and the classic look of Steam. One of those things just changed, though; Valve just released the most substantial overhaul to Steam in years, including a visual makeover and several new features. Further, the company has brought the Mac and Linux versions of Steam closer to parity with the historically superior Windows version. Valve says "the most impactful changes" are actually under the hood. The company's developers put effort into achieving greater consistency between how things work in Steam for desktop, the TV-oriented Big Picture mode, and Steam Deck. This codebase overhaul means that new features that come to the desktop version of Steam can simultaneously ship on Steam Deck with minimal effort.

As for stuff that's visible to users, though, the entire application's look has been overhauled and modernized. In most cases, things are more or less where they used to be in the interface -- they just look a little different, with new fonts, colors, sizes, and so on. That said, the in-game overlay has received a more significant overhaul, as did notifications. Steam users have access to more customizations about how and when notifications are displayed, and the notifications panel displays only new notifications, with a "view all" button for digging into older ones. In general, the overlay has more information about the game you're playing, from achievement progress to playing time and beyond. Valve has made big changes to the controller configurator from the Steam Deck, which is now part of the overlay whenever a game is connected.

Video Ads Are Coming To All Your Uber Apps (businessinsider.com) 57

According to the Wall Street Journal, Uber plans to introduce full-length video ads across a variety of its platforms for the first time this week. Insider reports: Riders will encounter ads that are up to 90 seconds long on Uber's app while waiting for pickup and during rides. Similar to New York City taxis, which introduced TV screens in 2007, select Uber cars will have tablets that auto-play ads as well, the WSJ reported. Video ads will also be incorporated across Uber Eats and Drizly, an alcohol delivery service acquired by Uber for over $1 billion in 2021, the WSJ reported. On Uber Eats, ads will display while customers wait for their deliveries, and on Drizly, ads will play on search results pages.

While this development is not exactly out of the blue -- Uber announced it would launch an advertising division to connect brands with customers in October -- the move to begin implementing them so swiftly shows how serious the company is about its goal of growing its advertising business to more than $1 billion in sales by 2024. Part of Uber's pitch to brands is its cache of user data. The company has information on where its users go, how often they travel to their destinations, and how long they spend in the car.
"We have two minutes of your attention," Mark Grether, vice president and general manager of Uber Technologies' advertising division, told the WSJ. "We know where you are, we know where you are going to, we know what you have eaten."

Grether added that Uber can use all of that data "to then basically target a video ad towards you."

Google Home's Script Editor Is Now Live (theverge.com) 23

Google has launched its script editor tool, offering advanced automations for Google Home-powered smart homes. The Verge reports: Available starting Tuesday, June 13th, to those in the Google Home public preview, the script editor is part of Google's new home.google.com web interface, which also has live feeds for any Nest cams on your account. The script editor will be coming to the new Google Home app preview starting June 14th. There's no date for general availability.

Along with allowing for multiple starters and actions, the script editor adds more advanced conditions. For example, you can set an automation to run only if the TV is on and it's after 6PM but before midnight. The script editor automations are created in the new Google Home web interface, you can apply for the public preview here.

The script editor allows you to do everything you can in the Home app when setting up automations, plus "more than 100 new features and capabilities to fit your unique understanding of your home and what you want it to do," according to a blog post by Anish Kattukaran, director of product management at Google Home. This includes access to nearly 100 starters and actions, including Matter sensors -- something not currently possible in the Home app. For example, an Eve Motion sensor connected via Matter to Google Home can't currently be used as a starter for automations in the Home app but can be used as one in the script editor.

TV Torrent Group CAKES Quits the Scene and Shuts Down 18

Piracy release group CAKES has shut down, dealing yet another hit for the piracy ecosystem. TorrentFreak reports: For several decades, The Scene has been the main source of all pirated content made available on the Internet. Technically, release groups operate in a closed ecosystem, but the reality is different. The vast majority of the files published on private Scene servers eventually find their way to public pirate sites. The secretive nature of The Scene has been a major challenge for law enforcement but in the summer of 2020, the US Department of Justice made a major breakthrough. Following a thorough investigation, three members of the illustrious SPARKS group were indicted. The raids and the criminal investigation sent shockwaves around The Scene. Some groups stopped releasing entirely and others significantly slowed down their output, which was felt in many parts of the public piracy ecosystem too.

Amid this turmoil, a new TV release group going by the name of CAKES emerged. The group published its first release "The 100 S07E16" on October 1, 2020, and many more would follow. During the next few years, CAKES built its reputation as a steady release group, one that eventually covered 7,000 titles. That's an impressive average of more than 50 new releases per week. Aside from the massive output, CAKES was also known for including four lines from Drake's track "Pound Cake" in its release notes. These same lines are also at the start of its farewell message.

The message explains that when CAKES started out, the team made an internal promise to pull the plug when "the love" is gone. Without going into further details, that time has apparently arrived. While some people may be disappointed with this decision, CAKES has clearly made up its mind. The group prefers to highlight the achievements and experiences instead, referring to the past few years as a "crazy journey." "If you had told us how the last few years would go, we wouldn't have believed you. The skills learnt, the massive lows, the euphoric highs, it couldn't have happened with a better group of people." "I couldn't be prouder of our team, not just for what was achieved but knowing the right moment to call time. As sad as this is, goodbye from team CAKES," the group adds.
GLHF, another piracy group, is mentioned in the farewell message. While no official shut down has been announced, TorrentFreak notes that "GLHF stopped releasing new titles over a week ago, which is highly atypical."

Apple TV+ 'Monsterverse' Show Filming In 3D For Vision Pro Viewing (macrumors.com) 40

The upcoming Apple TV+ show "Monarch: Legacy of Monsters," based on Legendary's Monsterverse franchise, is reportedly being shot in 3D format to support Apple's Vision Pro headset. If true, it would be the first confirmed TV+ show to support the 3D video-viewing capabilities of the headset, which offers a wide virtual screen environment and spatial audio. MacRumors reports: According to ScreenTimes' Sigmund Judge, the live-action Godzilla and Titans TV series that's based on Legendary's Monsterverse franchise has been shooting in a three-dimensional format supported by Apple's newly announced headset, based on conversations with people familiar with its production. [...] Apple announced its order for the Godzilla TV series in January 2022, but has not yet revealed when it will arrive on TV+.

The series takes place after the battle between Godzilla and the Titans leveled San Francisco, and will be produced by Legendary Television with co-creator Chris Black serving as executive producer and showrunner. Black is known for his work on "Star Trek: Enterprise" and "Outcast."

Along with FaceTime support and a redesigned Control Center, Apple is adding support for VPN apps in tvOS 17. MacRumors reports: VPN apps could allow for Apple TV users to watch geo-restricted content from any location, such as the U.S. version of Netflix in another country. In its tvOS 17 press release, however, Apple focused on how the VPN apps can benefit enterprise and education users, so it is possible that Apple could restrict usage of the apps.

Black Mirror Creator Says He Used ChatGPT To Write An Episode. It Was Terrible. 62

Charlie Brooker, the showrunner of "Black Mirror," revealed in an interview that he used OpenAI's ChatGPT to write an episode for the show's sixth season but deemed the results "shit." Gizmodo reports: "I've toyed around with ChatGPT a bit. The first thing I did was type 'generate Black Mirror episode' and it comes up with something that, at first glance, reads plausibly, but on second glance, is shit," the dystopian sci-fi auteur told Empire. "Because all it's done is look up all the synopses of Black Mirror episodes, and sort of mush them together. Then if you dig a bit more deeply you go, 'Oh, there's not actually any real original thought here.' It's [1970s impressionist] Mike Yarwood -- there's a topical reference."

While his experiments with generating an episode of Black Mirror with AI might have been deemed a failure, Brooker told the outlet that it did point out some of his writing cliches. "I was aware that I had written lots of episodes where someone goes 'Oh, I was inside a computer the whole time!'," he said. "So I thought, 'I'm just going to chuck out any sense of what I think a Black Mirror episode is.' There's no point in having an anthology show if you can't break your own rules. Just a sort of nice, cold glass of water in the face."

Netflix Password Crackdown Drives US Sign-Ups To Highest Levels In At Least Four Years (variety.com) 81

According to research company Antenna, Netflix's password crackdown in the U.S. has resulted in the "four single largest days of U.S. user sign-ups since January 2019, when Antenna first began tracking the metric," reports Variety. "On May 23, Netflix began notifying U.S. customers that users on their accounts who live outside their households would need to be added as an 'extra member' (or get their own subscriptions)." From the report: Based on the most current Antenna data available, Netflix average daily sign-ups reached 73,000 from May 25-28, a 102% increase from the prior 60-day average. That was more than the spikes in subscriber sign-ups Antenna recorded during the initial U.S. COVID-19 lockdowns in March and April 2020. Netflix U.S. cancelations also increased over May 25-28 -- a phenomenon the company told investors it expected -- but those were less than the number of sign-ups, according to Antenna. The ratio of sign-ups to cancelations since May 23 increased 25.6% compared with the previous 60-day period.

In the U.S., Netflix has told customers they must buy an "extra member" at an additional $7.99/month for anyone who doesn't live with them that currently uses their account. The streamer has said it will start blocking devices that attempt to access a Netflix account without having legitimate account access. According to New York-based Antenna, its estimates are based on millions of permission-based, consumer opt-in, raw transaction records, which are sourced "from a variety of data collection partners." The data includes online purchase receipts, credit, debit and banking data, and "bill-scrape data."

TV's streaming model is broken. It's also not going away. For Hollywood, figuring that out will be a horror show. From a report: Across the town, there's despair and creative destruction and all sorts of countervailing indicators. Certain shows that were enthusiastically green-lit two years ago probably wouldn't be made now. Yet there are still streamers burning mountains of cash to entertain audiences that already have too much to watch. Netflix has tightened the screws and recovered somewhat, but the inarguable consensus is that there is still a great deal of pain to come as the industry cuts back, consolidates, and fumbles toward a more functional economic framework. The high-stakes Writers Guild of America strike has focused attention on Hollywood's labor unrest, but the really systemic issue is streaming's busted math. There may be no problem more foundational than the way the system monetizes its biggest hits: It doesn't.

Just ask Shawn Ryan. In April, the veteran TV producer's latest show, the spy thriller The Night Agent, became the fifth-most-watched English-language original series in Netflix's history, generating 627 million viewing hours in its first four weeks. As it climbed to the heights of such platform-defining smashes as Stranger Things and Bridgerton, Ryan wondered how The Night Agent's success might be reflected in his compensation. "I had done the calculations. Half a billion hours is the equivalent of over 61 million people watching all ten episodes in 18 days. Those shows that air after the Super Bowl -- it's like having five or ten of them. So I asked my lawyer, 'What does that mean?'" recalls Ryan. As it turns out, not much. "In my case, it means that I got paid what I got paid. I'll get a little bonus when season two gets picked up and a nominal royalty fee for each additional episode that gets made. But if you think I'm going out and buying a private jet, you're way, way off."

Ryan says he'll probably make less money from The Night Agent than he did from The Shield, the cop drama he created in 2002, even though the latter ran on the then-nascent cable channel FX and never delivered Super Bowl numbers. "The promise was that if you made the company billions, you were going to get a lot of millions," he says. "That promise has gone away." Nobody is crying for Ryan, of course, and he wouldn't want them to. ("I'm not complaining!" he says. "I'm not unaware of my position relative to most people financially.") But he has a point. Once, in a more rational time, there was a direct relationship between the number of people who watched a show and the number of jets its creator could buy. More viewers meant higher ad rates, and the biggest hits could be sold to syndication and international markets. The people behind those hits got a cut, which is why the duo who invented Friends probably haven't flown commercial since the 1990s. Streaming shows, in contrast, have fewer ads (or none at all) and are typically confined to their original platforms forever. For the people who make TV, the connection between ratings and reward has been severed.

Crypto Companies Made 'Calculated' Decision To Flout Rules, Says SEC Chair (reuters.com) 26

The chair of the U.S. Securities and Exchange Commission on Thursday strongly rebutted criticism that the agency is trying to crush the crypto industry, and said many companies in the space had made a "calculated economic decision" to flout its rules. From a report: Speaking at a Piper Sandler conference in New York, Gary Gensler also reiterated his view that the "vast majority" of crypto tokens meet the test for being a security and should be registered with the SEC. That means most crypto exchanges have to comply with the securities laws too, he added. "When crypto asset market participants go on Twitter or TV and say they lacked 'fair notice' that their conduct could be illegal, don't believe it," he said. "They may have made a calculated economic decision to take the risk of enforcement as the cost of doing business." The crypto industry has attacked Gensler in recent days after the SEC sued two of the world's largest crypto exchanges, Coinbase and Binance, for allegedly breaking securities laws by failing to register their operations with the agency.

Smart TV Industry Rocked By Alleged Patent Conspiracy From Chipmaker (arstechnica.com) 27

An anonymous reader quotes a report from Ars Technica: During the pandemic, the demand for smart TVs dwindled as the supply chain for critical TV components became unreliable and consumers began tightening up on frivolous spending. Amid this smart TV demand slump, one of the world's top TV chipmakers, Taiwan-based Realtek, was hit with multiple meritless lawsuits by an alleged patent troll, Future Link Systems. These actions, Realtek said, drained its resources, made Realtek appear unreliable as a TV-chip supplier, and created "the harmful illusion of supply chain uncertainties in an already constrained industry." Determined to defend its reputation and maintain its dominant place in the market, Realtek filed a lawsuit (PDF) this week in a US district court in California. In it, the TV chipmaker alleged that Future Link launched "an unprecedented and unseemly conspiracy" with the world's leading TV-chip supplier, Taiwan-based MediaTek, and was allegedly paid a "bounty" to file frivolous patent infringement claims intended to drive Realtek out of the TV-chip market.

The scheme allegedly worked like this: Future Link "intentionally and knowingly" asked a US district court in Texas and the US International Trade Commission "for injunctions prohibiting importation of Realtek TV Chips and devices containing the same into the United States," Realtek alleged. This allowed MediaTek to reap the benefits of diminished competition in that market, Realtek claimed. Today, Reuters reported that MediaTek has officially responded to Realtek's allegations, vowing to defend itself against the lawsuit and claiming that MediaTek will supply evidence to dispute Realtek's claims.

Realtek's lawsuit seeks a jury trial to fight back against MediaTek and Future Link, as well as IPValue Management, which the complaint said owns and operates Future Link. The TV chipmaker alleged that defendants violated unfair competition laws in California, as well as federal laws. Any damages won from the lawsuit will be donated to charity, Realtek said. Realtek's complaint likens MediaTek to "robber barons of the Industrial Age," allegedly seeking to destroy competition and secure a monopoly in the TV-chip market. "With this action, Realtek seeks to stop a modern robber baron and its hired henchmen, protect itself from ongoing injury, and guard against the destruction of competition in the critical semiconductor industry by holding defendants accountable for their conspiracy," the complaint said.

Google Lifts Ban on Downloader App (arstechnica.com) 10

Google has reversed the suspension of an Android TV app that was hit with a copyright complaint simply because it is able to load a pirate website that can also be loaded in any standard web browser. From a report: The Downloader app, which combines a web browser with a file manager, is back in the Google Play Store after an absence of nearly three weeks. As we previously reported, Google suspended the app based on a Digital Millennium Copyright Act (DMCA) complaint from several Israeli TV companies that said the app "allows users to view the infamous copyright infringing website known as SDAROT." But that same website could be viewed on any standard browser, including Google's own Chrome app.

"The app was removed on May 19th due to the DMCA takedown request," developer Elias Saba wrote in a blog post today. "Instead of recognizing the absurdity of the claim that a web browser is somehow liable for all the unauthorized use of copyrighted content on the Internet, Google took a backseat and denied my appeal to have the app reinstated." The free app has been downloaded over 5 million times on Google Play and is available on the Amazon app store for devices such as Fire TVs. In addition to the rejected appeal, Saba filed a DMCA counter notification with Google. That "started a 10-business-day countdown for the [TV companies'] law firm to file legal actions against me," Saba wrote today. "Due to the app being removed on a Friday and the Memorial Day holiday, 10 business days had elapsed with no word from the law firm on June 6th and I contacted Google to have the app reinstated."
